Terms of Service
HearthTrades

HearthTrades, Inc. ("Company," "we," "our," or "us") provides a platform that connects homeowners with independent contractors. By using our platform, you acknowledge and agree to the following terms.
1. Contractor Vetting Standard
HearthTrades verifies that all contractors admitted to our platform have met the following minimum requirements prior to receiving any leads:
- Active Utah state contractor license verified through the Utah Division of Occupational and Professional Licensing (DOPL)
- General liability insurance with a minimum coverage of $1,000,000 per occurrence
- A minimum average rating of 4.2 stars with at least 10 verified reviews across public platforms
- Completion of a personal interview conducted by a HearthTrades team member
- Review and approval of past work portfolio and at least one client reference
Contractors who do not meet these standards are not admitted to the platform. Contractors who fall below our standards after admission are subject to removal.
This vetting process is provided as a service to homeowners to reduce risk in the contractor selection process. It does not constitute a guarantee of any specific job outcome, timeline, or workmanship quality.
2. No Guarantee of Work Outcome
While HearthTrades guarantees that every contractor on our platform has passed our vetting process, we do not guarantee the quality, safety, timeline, or completion of any specific job performed.
All services are delivered by independent contractors. Any agreement regarding the scope, quality, and outcome of work is strictly between the homeowner and the contractor.
3. Independent Contractors
All contractors using HearthTrades are independent and are not employees, agents, or representatives of the Company.
HearthTrades does not supervise, direct, or control the work performed by any contractor on the platform.
4. No Liability for Damages
HearthTrades is not responsible or liable for:
- Property damage resulting from contractor work
- Personal injury occurring during or after a project
- Financial loss related to contractor performance
- Poor workmanship or incomplete jobs
- Delays or failure to complete a project
Any dispute arising from work performed is strictly between the homeowner and the contractor.
5. No Warranty
The platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or reliability or availability.
6. Disputes Between Users
HearthTrades is not a party to any service agreements made between homeowners and contractors and does not mediate financial or contractual disputes between users.
However, HearthTrades takes quality and professionalism seriously. If a contractor on our platform is found to have acted unprofessionally, misrepresented their qualifications, or violated our platform standards, we will review their standing and take appropriate action up to and including permanent removal from the platform.

7. User Responsibility
Homeowners are responsible for:
- Clearly communicating project expectations and scope to their contractor
- Entering into a written agreement with their contractor before work begins
- Reviewing their matched contractor's profile, portfolio, and ratings before hiring
HearthTrades conducts licensing and insurance verification on your behalf. Homeowners are encouraged to review this information on their contractor's profile prior to hiring.
8. SMS Communications
By providing your phone number and creating an account or submitting a job request, you consent to receive SMS notifications from HearthTrades related to your account activity, job status updates, contractor matches, lead alerts, and occasional promotional messages. Message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for assistance.
9. Limitation of Liability
To the fullest extent permitted by law, HearthTrades shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the use of the platform.
10. Changes to These Terms
HearthTrades reserves the right to update these Terms of Service at any time. Continued use of the platform following any update constitutes acceptance of the revised terms. We encourage users to review this page periodically.
11. Acknowledgment
By using HearthTrades, you acknowledge that you have read, understood, and agree to these Terms of Service.
